What Legal Protections Are Available?

There are several legal measures designed to protect you and your loved ones from abuse:

  • Non-Molestation Orders: These court orders can prevent your abuser from threatening, harassing, or harming you or your children. It can stop the perpetrator from contacting you directly or indirectly and from coming near your home. Breaching a Non-Molestation Order is a criminal offence, which gives the order real power in safeguarding victims.
  • Occupation Orders: These can help you stay in your home and keep your abuser away, or decide who should leave the family home. You can apply for your abuser to leave your home even if they are the legal owner or joint tenant, which helps to create a safe environment for victims and their children.

If you have concerns regarding your children such as where they should live or who they should spend time with, there are orders that you could obtain such as a Child Arrangements Order – live with, or a Child Arrangements Order – spend time with.

Can I Get Legal Aid?

Legal aid is government funding that helps cover the cost of legal advice and representation if you cannot afford it. If you are a victim of domestic abuse, you may be eligible for legal aid, even if you have some savings or income. You will need to provide evidence of your means. Also, you will usually need to provide evidence of domestic abuse. This could include police reports, medical records, or confirmation from a domestic abuse charity.
