Year on year well over 100,000 employment tribunal claims are issued against UK employers. The last official statistics were before the pandemic and showed that employment claims have increased by 18%. We expect that this trend will only accelerate over the next few years.
Employees can bring claims against their employer even if there is no or little merit in relation to the claim. Unless protected by insurance, your organisation would then be put to the cost of defending this claim. The legal cost in defending an average Employment Tribunal claim exceeds £15,000.00. This does not include the cost for any settlement or award. Awards within the Employment Tribunal can be uncapped and have been known to run into many hundreds of thousands of pounds in the most serious cases.
If you wish to add insurance onto your retainer with us, we offer a comprehensive Employment Tribunal Insurance policy that is very different from what is offered by the majority of our competitors and there is NO excess to pay should litigation arise.
To help ensure that your organisation runs as smoothly as possible, we offer our clients insurance solutions to protect our clients should the unexpected happen. This insurance is offered as part of our Employment Law and HR retainer, as we know from our clients this is what they want. As such, we do not make any commission, profit or charge for arranging this cover for your organisation. We are not an insurance broker and we support our clients researching the whole market for the insurance product that best suits its requirements, however here is an outline of the policies we can easily arrange for your organisation as part of our IH In-house retained service.
This policy covers all costs associated with an Employment Tribunal Claim, including all legal costs and the cost of any settlement or award (save in relation to any contractual element).
You may have restrictive covenants in your employment contracts to protect your business interests should an employee or ex-employee attempt to trade in competition with (or work for a competitor of) your business. The policy, if this option is selected, will pay the costs involved in resolving legal disputes that arise from restrictive covenants.
The policy, if this option is selected, will represent you to appeal against the decision of a licensing or other authority, to change the terms of, suspend or revoke your business license or compulsory registration.
The policy, if this option is selected, will provide legal defence cover in the event your business (or Directors) is prosecuted under Health & Safety legislation
The policy, if this option is selected, will represent you in the event you are prosecuted under the Data Protection Act 2018 or receive a notice of formal investigation / disciplinary hearing by any professional or regulatory body.
