The injury happened when he opened the wardrobe in his hotel room in Tunisia. The door came off its rail and fell on his foot.

His foot was throbbing with pain but it took two hours for the medical assistant to arrive. The assistant didn’t have any equipment with him so was only able to provide rudimentary medical treatment.

The man required further treatment in the UK when he returned from holiday. He also had to take a week off work as a result of the injury.

He suffered substantial discomfort for six months and had trouble walking, especially on rough ground or uneven surfaces. It was 18 months before the pain completely disappeared.

He took legal action against the travel agent. He said that the company had been negligent in providing a room with a faulty wardrobe door and failing to carry
out safety and maintenance checks. It had also failed to provide him with reasonable medical care and attention.

The travel agent disputed liability but settled the case out of court. The man was awarded £4,500 for pain, suffering and loss of amenity.
