Housing Disrepair Claims

Section 11 of the Landlord and Tenant Act 1985, sets out your Local Authority or Housing Association’s responsibilities in relation to your rented property as follows:

  • to keep in repair the structure and exterior of the property (including drains, gutters and external pipes);
  • to keep in repair and proper working order the installations in the property for the supply of water, gas and electricity and for sanitation (including basins, sinks, baths and sanitary conveniences); and
  • to keep in repair and proper working order the installations in the property for space heating and heating water.

In addition to the above provisions in the Landlord and Tenant Act, the Homes (Fitness for Human Habitation) Act 2018 which came into force on 20 March 2019, provides additional rules which apply to any new tenancies granted on or after 20 March 2019, where the tenancy agreement term is less than 7 years and applies to all tenancies after 20 March 2020.

In accordance with the Homes (Fitness for Human Habitation) Act 2018, your Local Authority or Housing Association must ensure the property is:

  • fit for human habitation at the time the lease is granted or otherwise created or, if later, at the beginning of the term of the lease; and
  • will remain fit for human habitation during the term of the lease.
